Your Subscription Membership is a 'at a distance' digital relationship (not a legal business partnership) between the Website and yourself to support in a creative process that inspires you to maximise your personal and professional potential. It is designed to facilitate the creation/development of personal, professional or business goals and to provide you tools and information for you to develop and carry out your strategic planning for achieving those goals.

5. Client Responsibilities

5.1. The client is solely responsible for creating and implementing their own financial, professional, physical, mental and emotional well-being, decisions, choices, actions and results arising out of or resulting from the subscription membership. As such, the Client agrees that the website is not and will not be liable or responsible for any actions or inaction, or for any direct or indirect result of any services provided by the website. The client understands the website is not therapy or a professional service and does not substitute for therapy or a professional service if needed, and does not prevent, cure, or treat any mental disorder or medical disease.

5.2. The client further acknowledges that they may terminate or discontinue the subscription membership at any time.

5.3. The client acknowledges that the Website is a comprehensive process that may involve different areas of his or her life, including work, finances, health, relationships, education and recreation. The client agrees that deciding how to handle these issues, incorporate any information or tools from the Website into those areas and implementing choices is exclusively the Client’s responsibility. Furthermore, the Client acknowledges that they are wholly responsible for any and all outcomes from the subscription membership, information and tools.

5.4. The client acknowledges that the Website does not involve the diagnosis or treatment of mental disorders and that the website is not to be used as a substitute for counselling, psychotherapy, psychoanalysis, mental health care, substance abuse treatment, or other professional advice by financial, legal, medical or other qualified professionals and that it is the Client’s exclusive responsibility to seek such independent professional guidance as needed.

6. Payment

6.1. Where the option is given to you, you may make sign-up for a subscription membership and make payment for the Services (the ‘Services Fee’) by way of:
(a) Payment of service fees via direct debit

6.2. You agree and acknowledge that the www.strategyofone.com can vary the Services Fee at any time.

7. Refund Policy
​
7.1. www.strategyofone.com will only provide you with a refund of the Services Fee in the event they are unable to continue to provide the Services or makes a decision, at its absolute discretion, that it is reasonable to do so under the circumstances (the ‘Refund’).

9. Copyright and Intellectual Property

9.1. The Website, the Services and all of the related products of www.strategyofone.com are subject to copyright. The material on the Website is protected by copyright under the laws of Australia and through international treaties. (b) the website makes no guarantees, representations or warranties of any kind or nature, express or implied with respect to the services, information and / or tools provided. In no event shall the Website be liable to the Client for any indirect, consequential or special damages, whether at common law, under contract, tort (including negligence), in equity, pursuant to statute or otherwise. Notwithstanding any damages that the Client may incur, the Websites entire liability under this Agreement, and the Client’s exclusive remedy, shall be limited to the amount actually paid by the Client to the Website under this Agreement for all membership subscription services provided through and including the termination date.

11.3. Use of the Website and the Services is at your own risk. Everything on the Website and provided in the Services is provided to you “as is” and “as available” without warranty or condition of any kind. The Website does not make any express or implied representation or warranty about the Services or any products or Services referred to on the Website. Includes (but is not restricted to) loss or damage you might suffer as a result of any of the following:
(a) failure of performance, error, omission, interruption, deletion, defect, failure to correct defects, delay in operation or transmission, misinformation, poor judgement, computer virus or other harmful component, loss of data, communication line failure, unlawful third party conduct, or theft, destruction, alteration or unauthorised access to records;
(b) the accuracy, suitability or currency of any information on the Website, the Services, or any of its Services related products (including third party material on the Website);
(c) costs incurred as a result of you using the Website, the Services or any of the products of www.strategyofone.com; and
(d) the Services or operation in respect to links or reference which are provided for your convenience.

This shall include, but is not limited to, any loss of profit (whether incurred directly or indirectly), any loss of goodwill, personal or business reputation and any other tangible or intangible loss.

13. Termination of Contract

13.1. The Terms will continue to apply until terminated by either you or by the Website as set out below.

13.2. If you want to terminate the Terms, you may do so by:
(a) logging in and cancelling your subscription membership; or
(b) do not make a payment, and services will not be continued.

13.3. The Website may at any time, terminate the Terms with you if:
(a) you have breached any provision of the Terms or intend to breach any provision.
(b) the provision of the Services to you by the Website is, in the opinion of the Website, no longer commercially viable.
(c) have not made a payment in full five (5) business days prior to a scheduled renewal.
13.4. Subject to local applicable laws, www.strategyofone.com reserves the right to discontinue or cancel your membership at any time and may suspend or deny, in its sole discretion, your access to all or any portion of the Website or the Services without notice if you breach any provision of the Terms or any applicable law or if your conduct impacts www.strategyofone.com name or reputation or violates the rights of those of another party.

14. Indemnity

14.1. You agree to indemnify the Website, www.strategyofone.com and its employees against:
(a) all actions, suits, claims, demands, liabilities, costs, expenses, loss and damage (including legal fees on a full indemnity basis) incurred, suffered or arising out of or in connection with the Website or any Services provided;
(b) any direct or indirect consequences of you accessing, using or transacting on the Website or any Services provided; and/or
(c) any breach of the Terms.

15. Entire Agreement

15.1. This document reflects the entire agreement between the Website and the Client, and reflects a complete understanding of the parties with respect to the subject matter. This Agreement supersedes all prior written and oral representations. The Agreement may not be amended, altered or supplemented except in writing signed by both the Website and the Client.

16. Severance
If any part of these Terms is found to be void or unenforceable by a Court of competent jurisdiction, that part shall be severed and the rest of the Terms shall remain in force.​
